By using the Website, you are fully accepting the terms, conditions and disclaimers contained in this notice.

If you do not accept these Terms and Conditions, you must immediately stop using the Website. Use of the Website is at your own risk. The Website is provided on an “AS IS” and “AS AVAILABLE” basis without any representation or endorsement made and without warranty of any kind, whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Terms and Conditions of Sale 

These general terms and conditions of sale (“General Terms and Conditions of Sale”) apply to any order you place through www.onedanceuk.org (the “Website”). These General Terms and Conditions of Sale apply regardless of how you access the Website, including via any technologies or devices by which we makes the Website available to You at home, on the move. You must read these General Terms and Conditions of Sale carefully.

By placing an order through the Website, you confirm that you have read, understood and agree to these General Terms and Conditions of Sale in their entirety. If you do not agree to these General Terms and Conditions of Sale in their entirety, you must not order any product or service through the Website.

Purchases 

To purchase or renew your membership, you will be asked to open or update an account with us which will require you to provide some compulsory personal information. For all other purchases, you can choose to place your order via the guest checkout. Please note that you might be required to provide some personal information even when signing out as a guest.

We use Stripe, GoCardless and Google Pay for payments and you also have the option to pay offline by requesting an invoice (not available for Individuals or Students) sending in a cheque, doing a BACs transfer or paying by telephone call to One Dance UK. Downloadable or print products that you purchase are for your personal and non-commercial use only and must not be shared, copied or distributed in any format to other parties or the public without the express, prior and written permission of One Dance UK. We are committed to ensuring that the Intellectual Property rights of our licensed contributors and One Dance UK are upheld and protected.

Please see our Privacy and Cookie Policy for more information on how your personal information will be used. You confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects and at all times. You can update or correct your details at any time by contacting us through any of the contact details specified below.

Terms & Conditions for Direct Debit payments for One Dance UK membership 

All One Dance UK memberships last for a 12 month period. Upon taking out a One Dance UK membership and paying via Direct Debit you will be entitled to your membership benefits across 12 months.  

When you choose to onboard as a member, you will receive more detail about your chosen membership including benefits.  If you wish to cancel at that point, please contact membership@onedanceuk.org.  

By signing up to pay by Direct Debit, you are protected by the Direct Debit Guarantee*. If you opt for a monthly Direct Debit payment plan, your membership fee will be payable in twelve monthly instalments. If you have chosen to take up an annual Direct Debit you will be notified close to the expiry of your Direct Debit to renew your membership for another year. 

If you have chosen a monthly Direct Debit plan, GoCardless will send you a payment schedule outlining instalment amounts and dates for upcoming payments. GoCardless will inform you up to 3 days before the upcoming monthly payment is due.  

If any scheduled payment fails your bank will normally make you aware so that you can ensure funds are available for the Direct Debit to be presented again. If payment is not received by us within seven days of the date set out in the payment schedule we will inform you and give you the opportunity to settle the outstanding payment. If the Direct Debit is cancelled for any reason we will give you the option to set up the Direct Debit again or pay for the remaining installments of your annual membership through an alternative payment method.  

If you fail to pay the relevant amount due by the required date, sadly your One Dance UK membership will expire and you will no longer have access to you member benefits.

*Paying by Direct Debit  

The Direct Debit Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits. 

If there are any changes to the amount, date or frequency of your Direct Debit One Dance UK will notify you normally 10 working days in advance of your account being debited or as otherwise agreed. If you request for One Dance UK to collect a payment, confirmation of the amount and date will be given to you at the time of the request. 

If an error is made in the payment of your Direct Debit, by One Dance UK or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. 

If you receive a refund you are not entitled to, you must pay it back when One Dance UK asks you to 

You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify One Dance if you plan to cancel the Direct Debit for your membership fee.  

Acceptance of your order 

Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase membership, products or services from us. Our acceptance of your membership and/or order will take place only when we despatch the product(s), commence our services to you or process your membership. The duration of our contract with you will start from when you order and we take payment and process your order; or we take payment and dispatch any related products, until the last day of your right to cancel.

If we cannot supply you with the product or service you ordered, we will not process your order, inform you of this in writing (including email) and, if you have already paid for the product or service, refund you in full as soon as reasonably possible.

Payment 

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information, using an encrypted secure payment mechanism and will only use your information in accordance with our Privacy and Cookie Policy. All card payments are subject to authorisation by your card issuer.

VAT 

One Dance UK membership prices, products and other services are displayed in pounds Sterling and are inclusive of UK VAT where applicable.

Membership 

The duration of your membership is one year from the acceptance date (usually your purchase date).

Performance Optimisation Package (POP) add on 

The prices for this package include an administration fee of £15. 

BHSF Cash Plans 

This Health Cash Plan is sold by BHSF Services Limited and underwritten by BHSF Limited. BHSF Limited is covered by the FSCS and is authorised and regulated by the Financial Conduct Authority. BHSF Limited is authorised and regulated by the Prudential Regulation Authority.

POP screening 

This Screening is run by specialists either at the Trinity Laban Conservatoire of Music and Dance, London or at Birmingham Royal Ballet’s Jerwood Centre and University of Wolverhampton, Walsall Campus.

POP screening cancellation policy 

No Show/Short Cancellation Fee: Should something vital crop up and you need to cancel, please contact the relevant screening centre and NIDMS Manager (details listed below) and give as much notice as you can.

We will accept cancellations without penalty if you give us more than 48 hours’ notice; however without that notice, the following charges apply: –  Missed Appointments/Cancellation within 48hrs of appointment – Full fee required. As the screening forms part of your Performance Optimisation Package, a replacement screen will not be offered unless an additional screening fee is paid (please enquire). NIDMS and all screening partners reserve the right to cancel a screening with 3 weeks notice if the minimum capacity for screening is not reached. In this instance, the NIDMS manager will liaise with you to reschedule.

Passwords 

When you create an account we may provide you with and/or ask you to use passwords or other means to allow you to access certain areas of the Website and/or to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. We shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

One Dance UK Gifted Memberships

• Gift Membership cards are valid for 12 months after the date of purchase and should be redeemed to activate the membership within this time
• Gift Membership cards must be activated using the unique code located on the card. If the unique code is mislaid, the Membership cannot be activated
• After the 12 months have lapsed, the activation code will be invalid
• Gift Membership cards have no cash value and are for One Dance UK membership packages only and are excluded from any membership discounts and offers
• Gift Membership cards may not be transferred
• Proof of purchase will not be accepted in lieu of the unique gift card code
• At the point of activation, the gift recipient will become a One Dance UK Member and will be bound by the usual One Dance UK Membership Terms and Condition
• The One Dance UK Membership will last for twelve months from the point of activation. One Dance UK will subsequently write to the member and invite them to renew at the end of their 12 month membership period
• If for any reason you are unhappy with your Gift Membership card purchase, you have the right to cancel the order and receive a full refund (excluding postage) without giving a reason within 14 days of the date of purchase
• Gift Membership cards cannot be cancelled and refunded if the activation code has already been used to activate the Membership
• One Dance UK will not refund or replace Gift Membership cards where the unique code has been lost or mislaid. You must be able to provide the inactivated unique code in order to receive a refund

Liability 

There are certain liabilities which we cannot exclude by law and nothing in these General Terms and Conditions of Sale limits our liability for personal injury or death caused by our negligence or for fraud. You have certain rights as a consumer, including statutory rights relating to faulty or misdescribed goods and services. For further information about your statutory rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.

Nothing in these General Terms and Conditions of Sale will affect these statutory rights and, in particular, we will perform our obligations under these General Terms and Conditions of Sale with reasonable care and skill. Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you can contact us for replacement or, where this is not possible, for a refund.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms and Conditions of Sale. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms and Conditions of Sale by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control. In any event we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

You may not assign or sub-contract any of your rights or obligations under these General Terms and Conditions of Sale to any third party unless we agree in writing. We may assign, transfer or sub-contract any of our rights or obligations under these General Terms and Conditions of Sale to any third party at our discretion.

No relaxation or delay by us in exercising any right or remedy under these General Terms and Conditions of Sale shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing.

If any of these General Terms and Conditions of Sale are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these General Terms and Conditions of Sale shall remain in full force and effect. Only you and we shall be entitled to enforce these Terms of Sale. No third party shall be entitled to enforce any of these Terms of Sale, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.

OTHER AREAS

Public Voting 

In relation to One Dance UK Awards. Please note that in the event of a tie, or a near tie between nominees (whereby the percentage of the total vote results sit within 1% or less of each other) One Dance UK reserves the right to put the nominees to a vote by an independent panel of experts.  We also reserve the right to monitor and authenticate any voting patterns or activity that are deemed as or flagged as being potentially suspicious, using Survey Monkeys analytical tools.

 Prize Draws

1. By entering any prize draw/s you are agreeing to these prize draw terms and conditions.

2. The prize draw is free to enter and is open to entrants over 18 years of age. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win.

3. A maximum of one entry per individual is permitted unless otherwise specified. One Dance UK members automatically receive an additional entry where stated. Please confirm your membership number or notify us that you are a member/work for a member organisation when entering the relevant competitions- it will state this in the body copy of the competition promotion.

4. To enter follow the instructions outlined in the prize draw communications. Entries made after the submission date will not be included in the draw.  One Dance UK will not accept responsibility if contact details provided are incomplete or inaccurate.

5. One Dance UK’s use of particular brands/partners as prizes does not imply any endorsement of such brands/partners.

6. The winner will be drawn at random. The prize is non-exchangeable, non-transferable and no cash alternatives will be offered. We reserve the right to substitute prizes with another prize of equal or higher value if circumstances beyond our control make it necessary to do so. The decision regarding any aspect of the prize draw is final and binding and no correspondence will be entered into.

7. Winner announcement: The winner will be notified after the draw, via the email or social media account provided during entry. One Dance UK will attempt to contact the winner by email up to three times. If the winner does not respond to the emails notifying them of their win within two days of being contacted three times, they will lose their right to the prize, and One Dance UK reserves the right to choose and notify a new winner.

8. Data protection and publicity: You consent to any personal information you provide in entering the prize draw being used by One Dance UK for the purposes of administering the prize draw, and you will be requested to pass on contact details to affiliates/partners to allow you to access the prize. An announcement of the winner’s name may be made via One Dance UK and prize draw partners’ social media channels. All personal information shall be used in accordance with One Dance UK’s Privacy Notice.

9. Limitation of Liability: One Dance UK does not accept any liability for any damage, loss, injury or disappointment suffered by any entrants as a result of either participating in the prize draw or being selected for a prize.

10. One Dance UK or prize draw partners reserve the right to cancel the prize draw or amend these terms and conditions at any time, without prior notice. The prize draw and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of Great Britain.

10a. Where a prize is given for a specific purpose (e.g. towards the cost of work), ODUK may require an invoice and receipts in order to reimburse you. If you are unsure if whether something will qualify, do reach out. ODUk reserves the right to refuse payment should it be for purposes that do not fall in line with the terms stated in the original postings.
